DECISION OF THE BOARD
1This is an application for certification in which a hearing had commenced to address some matters in dispute.
2The employer has now advised the Board that it is withdrawing its position regarding “build up” and section 8.1 of the Labour Relations Act, 1995 (the “Act”). All parties agree that there are no remaining issues for the Board to decide.
3The Board notes that the applicant has agreed to the responding party’s proposed bargaining unit. The bargaining unit description is therefore as follows:
all employees of Canadian Waste Services Inc. regularly employed at 117 Wentworth Court, in the City of Brampton, save and except supervisors and persons above the rank of supervisor, office, clerical and sales staff, persons employed for not more than twenty-four (24) hours per week, and students employed during the school vacation period.
Clarity Note: The position of scale operator is considered to be an office or clerical staff position.
4On the taking of the representation vote the ballot box had been sealed pending the resolution of the matters in dispute. As the parties no longer have any matters in dispute, the Manager of Field Services is directed to appoint a Labour Relations Officer to meet with the parties in order to open the ballot box and count the ballots cast.
