DECISION OF THE BOARD; January 7, 2000
1This is an employer appeal of an order to pay issued by an Employment Standards Officer and dated July 9, 1999.
2The Board is in receipt of Minutes of Settlement dated December 14, 1999 and signed by the applicant employer and the employee. There is a subsequent request by the applicant employer dated December 20, 1999 requesting that the application be withdrawn. The basis for the withdrawal request does not set out in detail the factual basis of the allegations, but the applicant employer no longer wishes to comply with the settlement.
3Having regard to the circumstances under which the applicant employer is requesting to withdraw the application, the Board is not prepared to grant leave to withdraw and a hearing of this matter is scheduled for January 25, 2000, commencing at 9:30 a.m. in the “Toronto Dominion Room” at the Cleary International Centre, 201 Riverside Drive West, Windsor, Ontario.
