Decision
1This is an employer appeal of an Order to Pay issued by an Employment Standards Officer.
2The hearing in this matter was scheduled for April 18, 2000 at 9:30 a.m.
3Although it appears from the file that the applicant had been given notice of the hearing, the applicant was not in attendance at 9:30 a.m., the time the hearing was to commence. As is its practice, the Board waited half an hour for the applicant to appear. It did not do so.
4Accordingly, the Board orally dismissed the application. This decision confirms that oral decision.
Disposition
5I hereby order that the wages paid to the “Director in Trust” in relation to this matter be disbursed to the employees, and the administration fee as set out in the Order to Pay be retained by the Government of Ontario Consolidated Revenue Fund.
