1This is an employer appeal of an Order to Pay Number 53485 which was issued by an Employment Standards Officer.
2By notice dated December 22, 1999 the Board’s Registrar notified the parties that the hearing of the employer’s appeal would be held Thursday, January 27, 2000 at 9:30 a.m. A review of the file suggests that the notice was mailed to the applicant.
3When the hearing was to commence on January 27, 2000 at 9:30 a.m., the applicant was not present. The Board waited one hour, but the applicant had still not appeared. The Board then dismissed the appeal.
Disposition
4This decision confirms that the applicant’s appeal is dismissed. I hereby order that the wages paid to the “Director in Trust” in relation to this matter be paid to the responding party Maryellen Gilmour and that the administration fee as set out in the Order to Pay be retained by the Government of Ontario Consolidated Revenue Fund.
