DECISION OF THE BOARD; March 20, 2000
1This is an application for a review of an Order to Pay, filed pursuant to section 68 of the Employment Standards Act, R.S.O. 1990 ch. E-14 (the “Act’). This application was delivered to the offices of the Director of Employment Standards on March 10, 2000. The final date for filing an application for review was March 13, 2000. However, the Order to Pay quite clearly states that the application is to be delivered to the offices of the Ontario Labour Relations Board at 505 University Avenue, 2nd floor, Toronto, Ontario, M5G 2P1 by the final date. The Board in fact received a copy of the application for Review from the Employment Practices Branch rather than the applicant. It was received in the Board’s offices on March 15, 2000, two days after the deadline for doing so.
2The Board has the power to extend the time for filing an application under section 68(4) of the Act. It is appropriate to do so here. However, the applicant is cautioned that the Board expects him to read all documents received from the Board carefully. He should not assume that the Board will continue to relieve against errors on his part.
