DECISION OF THE BOARD; August 16, 2000
1This is a referral of a grievance in the construction industry, pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”).
2By letter dated August 16, 2000, counsel for the applicant wrote:
The Applicant in the above-captioned matter agrees to the request of the Responding Party to adjourn the hearing scheduled for August 17, 2000 on condition that the Responding Party produce on or before August 31, 2000, all documentation relating to the Zeller’s Store, Simcoe, Ontario as specified in a Summons duces tecum to be provided to counsel for the Responding Party.
3Having regard to the apparent agreement of the parties, this matter is adjourned sine die for a period not exceeding one year. Unless within that time either party requests that the Board proceed with the matter, it will be deemed terminated without any further notice to the parties.
4We will leave the experienced counsel in this matter to sort out the production issues.
