DECISION OF THE BOARD; March 29, 2000
1A number of Board decisions have been issued with respect to this employer appeal requesting a review of Order to Pay No. 32601.
2The employer filed an Authorization and Direction dated February 18, 200 and signed by the employee, Valerie Vatour, which acknowledges that all matters at issue between the parties have been resolved. The employee authorized the Ministry to return all the moneys paid to the Director to the employer payable to “Zeppieri & Associates, in Trust”.
3The Ministry in its letter of March 8, 2000 takes the position that the Order to Pay was not rescinded and in these circumstances the Board is without jurisdiction to return the administration fee.
4Where an appeal has been settled or withdrawn the Board is without jurisdiction to direct the return of the administration fee.
5The amount paid to the Director of Employment Standards in Trust is $1,917.75. This amount includes a 10% administration fee of $174.34.
DISPOSITION
6The Board orders the Director to remit to the applicant the sum of $l,743.41 together with accrued interest. This amount is to be made payable to “Zeppieri & Associates, in Trust” pursuant to the authorization signed by the employee, Valerie Vatour.
7This matter is terminated.
