Decision
1This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the "Act") alleging violation of sections 17, 70, 72 and 86.
2Briefly put. the applicant’s primary allegation is that the responding party violated these sections of the Act by contracting out custodial work. The complaint also refers to the contracting out of snow removal and the discontinuance the employee assistance program.
3By letter dated February 8, 2000, the applicant seeks an order that the responding party produce several documents (including letters, memoranda and e-mail).
4The Board directs the responding party to produce for the applicant those documents within its possession or control which it does not object to producing. If the responding party objects to producing any of the requested documents, it shall file with the Board a statement of the nature and reasons for its objection Board within five days of its receipt of this decision (excluding Saturdays, Sundays and other days on which the Board is closed).
5Upon receipt of the responding party’s objections, if any, the Board will consider the applicant’s request further.
