DECISION OF THE BOARD; February 8, 2000
1Further to the Board’s decision in this matter, dated January 27, 2000, the parties have made their submissions with respect to the applicant employer’s request for production of documents.
2Mr. Wendell Hunte submits that some of the documentation does not exist and appears to refuse to produce other documents. Mr. Hunte is requesting production of some documents from the employer, some of which have been provided or are about to be forwarded to Mr. Hunte.
3Section 68(10) and (11) of the Employment Standards Act provide as follows:
- (10) The Board shall determine its own practice and
procedure but shall give full opportunity to the parties to present
their evidence and to make their submissions.
(11) The chair of the Board may make rules governing the Board’s practice and procedure and the exercise of its powers and prescribing such forms as the chair considers advisable.
Rule 48 provides:
- The Board may direct that any person be added or removed as a party or be sent any document, as the Board considers advisable.
4The parties are directed to bring all relevant documents in their possession and/or control with them on the day scheduled for hearing this matter. Further, Mr. Hunte is directed to bring with him his Income Tax Returns for the relevant time period.
5If the parties are unable to agree as to what documents are relevant and are to be produced prior to the hearing, the panel of the Board hearing this matter will determine what documents shall be produced.
