Decision of the Board
1By way of correspondence dated January 11, 2000 the Board has received a request for reconsideration of its decision of December 23, 1999.
2In its decision of December 23, 1999, the Board did not decide that there is no issue with respect to the RTS Nova Buses about which the applicants might file a complaint with the Ministry. The Board did decide that, as an ergonomic assessment was completed of the buses, it should not proceed with the appeal of the inspector’s decision not to order an ergonomic assessment. If the applicants are dissatisfied with the ergonomic assessment, they must complain to the Ministry about those deficiencies first. If they receive an unsatisfactory decision from the inspector they can file an appeal. If the applicants have specific complaints about the buses that they wish to bring to the attention of an inspector they may do that as well and if they are dissatisfied with his decision they can file an appeal about that.
3The Board has reviewed the request for reconsideration. It does not purport to provide any arguments or evidence with respect to the issue under appeal which would not have been available to the applicants at the hearing of this matter. This request for reconsideration is therefore denied.
