1007-99-HS Niagara Region Police Association, Applicant v. Niagara Regional Police Service and Ministry of Labour, Responding Parties.
BEFORE: Stephen Raymond, Vice-Chair.
APPEARANCES: Paul DiSimoni for Niagara Region Police Association; Gordon A. Wiggins for Niagara Regional Police Service; Victoria Kondo for the Ministry of Labour.
DECISION OF THE BOARD; August 1, 2000
The responding party, the Niagara Regional Police Services Board (the “Police Board”) requested an adjournment of the hearing. The Ministry of Labour (the “Ministry of Labour”) consented to the request. The Niagara Region Police Association (the “Association”) objected to the request.
The Police Board took the position that if the matter was adjourned for a month or so that the matter might be resolved. The Board is of the view given the nature of the dispute that the matter may resolve within that timeframe and accordingly the adjournment was granted.
The matter was rescheduled for hearing on September 18, 2000.
It appears that the issue at the hearing will be whether there are any interim measures that may be necessary to protect the health and safety of police officers during the time period in which a new communications system is being implemented.
The Police Board and the Association were directed to exchange with each other and to file with the Board and the Ministry of Labour any and all documentation on which the parties intend to rely at the hearing on or before September 8, 2000. The parties were also directed to provide to each other the identities of any witnesses that they intend to call and a description of the evidence that those witnesses will provide.
I remain seized of this matter.
“Stephen Raymond”
for the Board
