This is an application pursuant to section 68 of the Employment Standards Act (the “Act”). The Board has issued two other decisions with respect to settlements between the employer and some of the employees. The employer and two more employees have now entered into Minutes of Settlement. The settlement documents were forwarded to the Board by the Ministry of Labour indicating its approval of the contents.
The Ministry of Labour has also indicated that it is prepared to return ten percent of the settlement amount to the employer as an administrative fee.
Therefore, pursuant to the agreement between the parties the Board hereby directs that monies held by the Director in Trust be disbursed as follows:
