DECISION OF THE BOARD; April 6, 2000
This is an employer appeal of an Order to Pay issued by an Employment Standards Officer pursuant to section 68 of the Employment Standards Act (“the Act”).
A hearing to consider the employer’s appeal was scheduled for March 30, 2000 at 9:30 a.m. Notice of the hearing was given to and received by all parties.
No one appeared on behalf of the employer at the scheduled start time of 9:30 a.m. The Board waited more than its customary one-half hour, but no one appeared. Accordingly, the Board dismissed the application.
This decision confirms the oral ruling that this application is dismissed.
Disposition
- The employer’s appeal is dismissed. The Board hereby orders that the wages paid to the “Director in Trust” in relation to this matter be disbursed to the employee, and that the administration fee as set out in the Order to Pay be retained by the Government of Ontario Consolidated Revenue Fund.
