DECISION OF THE BOARD; May 4, 2000
Decision
1The Board has received requests from the responding parties for an adjournment of the dates set for May 8 and 9, 2000 in these matters, due to the unavailability of counsel. The applicant opposes this request. No party has suggested what alternative dates might be available to all counsel.
2Interim applications are typically scheduled by the Board on short notice (reflected in the shorter time frame for filing requirements). The Board does not generally regard availability of counsel as a reason for adjourning a proceeding which has not yet commenced. The Board notes that no party suggested a date available to all counsel which is close to the scheduled date.
3However, this matter has been scheduled for two days. The Board’s practice in hearing interim applications excludes the calling of evidence, and this matter should take less than a full day to argue. Accordingly, these applications will proceed on Monday May 8, 2000, but the hearing set for May 9 will be cancelled.
4The Board also wishes to draw the parties’ attention to the recent decision of the Board on interim applications in Board File 3953-99-M, Amalgamated Transit Union, Local 1731 and McIntosh Limousine Service Ltd. et. al. (April 28, 2000).
