DECISION OF THE BOARD; March 21, 2000
Section 68 of the Employment Standards Act (the “Act”) stipulates that an application for review must be made within 45 days after the date of the Order to Pay. The Order to Pay at issue in this matter #56356 is dated November 15, 1999. That means the application together with the required payment must be filed with the Ontario Labour Relations Board on or before December 30, 1999. The application was received by the Board on January 12, 2000.
By letter dated March 7, 2000 the Registrar of the Board advised the applicant that the application appeared not to be timely and requested the applicant to respond within ten (10) days (of March 7, 2000) to advise the Board why the appeal should be considered timely and/or why an extension of time for filing the appeal should be granted.
DISPOSITION
- As of the date of this decision no response has been received by the Board. The matter is dismissed on the basis that it is not filed in a timely manner.
