DECISION OF THE BOARD; May 4, 2000
Decision
1The Board is in receipt of correspondence dated April 27, 2000 and May 1, 2000 from counsel for the applicant and Marduk Associates Inc. respectively with respect to document production. Having regard to such correspondence, both responding parties are hereby directed to produce those documents in their possession for review to Applicant’s counsel no later than June 1, 2000. Following receipt of such documents, the applicant may renew its request for a Board order requiring the responding parties to produce further documents. Should the applicant wish to make such a request it should be made no later than June 12, 2000 in order to ensure that the responding parties have opportunity to respond to the request and the Board has time, if it considers it appropriate to do so, to issue orders concerning document production in advance of the first hearing date.
