DECISION OF THE BOARD; June 29, 2000
1This is an application under section 69 and subsection 1(4) of the Labour Relations Act, 1995.
2In a decision dated May 31, 2000, the Board recited the parties’ Memorandum of Settlement in which they agreed to a vote to be held on June 20, 2000. The vote was cancelled because the responding party Office & Professional Employees International Union Local 161 advised the Board by letter dated June 13, 2000 as follows:
On behalf of the Respondent, Office and Professional Employees International Union Local 161, we are requesting our name be removed from the ballot.
3It is not clear what is intended by this letter, in as much as a withdrawal from the ballot may or may not mean a lack of interest in the application altogether.
4The parties are hereby advised that (subject to consideration of the parties’ submissions) the Board intends to declare that the applicant, Ontario Public Service Employees Union is the bargaining agent for the employees in the following bargaining unit:
All employees of Jeanne Sauve Family Services, save and except supervisors, persons above the rank of supervisor, administrative assistant, executive secretary, secretary bookkeeper, and students employed during the school vacation period.
5The parties are directed to make submissions to the Board by no later than July, 6, 2000, if they object to this declaration being made. If no submissions are received, the declaration will issue.
