DECISION OF THE BOARD; March 24, 2000
1This is an application under section 133 of the Labour Relations Act, 1995 (the “Act”).
2The responding party was provided with notice of the hearing but failed to attend.
3On the basis of the evidence of Dino Fransecutti, business agent with the applicant, the Board is satisfied that the responding party is bound to the Drywall Residential Collective Agreement between Local 675 and the Interior Systems Contractors Association effective April 30, 1998 to May 1, 2001 and failed to pay benefits, dues, contributions and deductions for the work months of December, 1999 and January and February, 2000 contrary to the provisions of the collective agreement in the amount of $4,115.32. The applicant has paid fees in connection with the filing of this grievance and the conduct of the hearing in the amount of $749.00.
4On the basis of the foregoing, the Board hereby orders the responding party to forthwith pay to the applicant the sum of $4,864.32.
