DECISION OF THE BOARD; July 14, 2000
The applicant has referred a grievance concerning the interpretation, application, administration or alleged violation of a collective agreement to the Board for final and binding determination.
Prior to the hearing in this matter the parties entered into Minutes of Settlement dated July 12, 2000. Having regard to the Minutes of Settlement, to the representations before it and pursuant to section 133 of the Labour Relations Act, 1995 (the "Act"), the Board make the following determination:
declares that the responding party is bound to the Provincial Collective Agreement between the Carpenters Employer Bargaining Agency and the Carpenters District Council of Ontario United Brotherhood of Carpenters and Joiners of America, effective May 1, 1998 to April 30, 2001.
declares that the responding party has violated Articles 4 and 5 of the Provincial Collective Agreement on the Staples/Business Depot site Quinte Mall, Belleville, Ontario.
orders that the responding party pay to the applicant, as damages, the amount of $6,500.00 (six thousand five hundred dollars), as full and final settlement for the above violations of the Collective Agreement, and that such payment be made on or before July 17, 2000.
