DECISION OF THE BOARD; February 21, 2000
This is an application under section 21, 22 and/or 23 of the Public Sector Labour Relations Transition Act, 1997 (the “Act”).
The parties have reached an agreement on both the description and composition of the bargaining unit. Pursuant to that agreement and in accordance with section 23 of the Act, the Board directs that a representation vote be held relating to the following bargaining unit:
all office and clerical employees employed at the Queensway-Carleton Hospital in the City of Nepean, save and except Supervisors, persons above the rank of Supervisor; Payroll Officer; Payroll Clerk; Secretary, Occupational Health & Safety; Secretary to Directors of Nursing; Secretary to Board of Directors/MAC/Medical Directors; Secretary to Vice Presidents; Clinical Education Coordinator; Secretary, Human Resources; Human Resources Information Analyst; Employment Services Officer; Training and Development Assistant; Team Leader Staffing Clerk; QCH Foundation employees; Security Guards; Administrative Assistant to the CEO.
Clarity Note:
For further clarity the parties agree and understand the following:
The scope geographically of the unit will be whatever the City of Nepean falls under upon City amalgamation.
Unpaid volunteers are not included in the bargaining unit.
The Team Leader Staffing Clerk position is presently held by Linda Scobie.
The Staffing Clerk positions are included in this description for the purposes of this Bill 136 Application only and such inclusion is on a without precedent/without prejudice basis to any position taken elsewhere.
The ACC Ward Clerks are included in this description.
The Buyer/Planning and Secretary/Planning positions presently filled on a contract-term basis until the end of December, 2000 are excluded from this unit only for this contract-term and would be otherwise included in the unit.
Pursuant to the agreement of the parties, employees in the bargaining unit described in paragraph 2 employed as of February 18, 2000 are entitled to vote.
Employees will be asked whether they wish to be represented by Canadian Union of Public Employees Local 4000 in their employment relations with the Queensway-Carleton Hospital.
The vote will be held on March 9, 2000. Vote arrangements are set out in the attached “Notice of Vote”.
The Queensway-Carleton Hospital is directed to post copies of this decision and the “Notice of Vote”, to remain posted until seven calendar days after the vote.
In the event that an issue arises concerning the conduct of the vote which any party or person wishes to raise with the Board, such party or person must file written submissions with the Board and deliver them to the other parties so that they are received within five days (not including weekends or holidays on which the Board is closed) of the date the vote is taken.
The panel of the Board is not seized with this matter.
