DECISION OF THE BOARD
1The Adjudicator/Referee has received correspondence from the applicant in this matter requesting, among other things, an adjournment of the date set to rehear this matter. The only response from the Ministry indicates that it may need an adjournment as well. There has been no response from the responding party. In the unfortunate circumstances of this case and given that no one has opposed the request for adjournment I consider it appropriate to grant it. Also in the particular circumstances of this case the Registrar will consult with the parties to set a hearing date. However, if that process is not quickly successful in achieving a hearing date that is mutually satisfactory to the parties the Registrar will again set one peremptorily.
2The applicant has also questioned this Adjudicator/Referee’s jurisdiction to hear this matter as a hearing was previously held before another Adjudicator/Referee. I hereby direct the other parties to file submissions with respect to that issue on or before Friday September 29, 2000. The representative of the other claimants, whose order to pay has been held in abeyance pending the outcome of this hearing is also invited to file submissions with respect to this issue. If there are any other preliminary matters this would be an appropriate opportunity to raise them as well. I will try to render decisions on these matters prior to the hearing. However, if I determine that further argument is required they will be dealt with at the hearing.
3I have also noted the applicant’s request that the Board pay the costs of the parties having to attend the hearing. This request will be dealt with along with my decision with respect to my jurisdiction to hear the matter.
4The hearing scheduled for September 25, 2000 is hereby adjourned.
