CONSENT ORDER
In order to resolve all outstanding issues arising from the various applications and allegations filed to date (whether or not a Board File No. has been assigned) it is agreed as follows:
- The Board shall order a representation vote of the following group of employees of Satisfied Brake Products Inc.:
all employees of Satisfied Brake Products Inc. in the City of Cornwall, save and except Quality Assurance Technicians, Facilitators, Millwrights, Production Control Assistants, supervisors, those above the rank of supervisor, office and clerical employees and students employed during the school vacation period.
Any employee falling within the bargaining unit description in paragraph 1 and who had an employment relationship with the Employer as of this date shall be eligible to vote.
Eligible employees shall be given a choice on the ballot as to whether they wish to be represented by either the Applicant or the Responding Party Union as follows:
IWA Canada
or
Satisfied Brake Products Employees Association,
Local 101 of the United Brotherhood of Retail,
Food, Industrial and Service Trades International
Union.
The representation vote shall be held on April 17, 2000.
Other vote arrangements will be as determined by an officer of the Board in consultation with the parties and in accordance with the Board’s usual practice.
It is agreed that the Responding party Union shall not hold any meetings of employees on the Employer’s premises or on “company time” nor will the Responding Party Union use its authority to be on the Employer’s premises to campaign for the vote.
The parties agree that by signing this document all outstanding issues between and amongst them are resolved and in future no party shall be entitled to plead and rely upon any matter whatsoever which occurred prior to today’s date.
It is agreed that the matter of discipline issued to Steve Jones, Marcel Dupuis and Glen Schiller shall be dealt with as grievances. The Company agrees to waive any time limits in this regard. The grievances will be placed on hold until after the vote, at which time the successful Union shall have the right to process the grievances to arbitration.
The Company shall provide the IWA Canada and Local 101 an up to date employee list by April 4, 2000, which shall be faxed to counsel’s office.
