0432-00-JD The Corporation of the City of Kitchener, Applicant v. Canadian Union of Public Employees, Local 791 and International Brotherhood of Electrical Workers, Local 636, Responding Parties.
BEFORE: Stephen Raymond, Vice-Chair, and Board Members J. A. Ronson and D. A. Patterson.
DECISION OF THE BOARD; June 6, 2000
1The Corporation of the City of Kitchener brought a jurisdictional dispute application on May 9, 2000. The responding parties were served with the material. On May 29, 2000, the International Brotherhood of Electrical Workers (“IBEW”) responded to the application.
2On June 5, 2000, counsel for Canadian Union of Public Employees (“CUPE”) wrote to the Board and indicated that they had been retained on May 31, 2000 and requested an extension for the filing of the response on behalf of CUPE until June 14, 2000. Counsel for the IBEW had written to the Board on June 2, 2000 objecting to any late filing by CUPE and enclosed additional material upon which it intended to rely. CUPE objected to the filing of this material. The consultation set for June 13, 2000 was adjourned to July 7, 2000.
3The Board hereby directs that the time limits for the filing of the response on behalf of CUPE be extended until June 14, 2000 and further directs that all parties file by that date with the Board and all other parties any material upon which they intend to rely at the consultation on July 13, 2000.
