All Three West Indian Restaurant v. Deloris Small and Ministry of Labour
File No.: 2813-99-ES Date: January 25, 2000
Before: Inge M. Stamp, Vice-Chair
Decision of the Board
1By letter dated August 5, 1999, All Three West Indian Restaurant advised the Director of Employment Standards that it was seeking an application for review of an Order to Pay issued against it. The letter indicates that the order to pay resulted in a garnishment against the employer.
2The Board assumed that All Three West Indian Restaurant was attempting to file an application for review pursuant to section 68 of the Employment Standards Act (the "Act"). It therefore sent All Three West Indian Restaurant a letter dated December 20, 1999 indicating that the Board was unable to process the application as it had not been filed on the correct form and did not comply with the Board's Rules of Procedure. The Board sent All Three West Indian Restaurant a set of the appropriate forms and the pertinent rules, and directed that All Three West Indian Restaurant had an additional 20 working days in which to file its application properly.
3To date the Board has received nothing further from All Three West Indian Restaurant. As the 20 days have now passed, it would appear that All Three West Indian Restaurant does not wish to file an application for review in this matter.
Disposition
4This matter is hereby terminated.
