DECISION OF THE BOARD; July 7, 2000
This is an application for review by an employee of an order to pay made by an Employment Standards Officer under the Employment Standards Act.
The hearing was scheduled to commence at 9:30 a.m. on July 5, 2000. Notice of the Hearing was provided to the employer. The employer did not attend. Accordingly, the hearing proceeded in the employer’s absence.
The employee testified that she was employed by the employer for the period June 30 to August 28, 1998. The employee testified that she was to be paid a base salary of $2,000.00 per month but she was never paid this salary. She was, however, paid $35.00 pursuant to the order of the Officer.
On the basis of the employee’s evidence, I find that the employee is owed $4,000.00 in wages, less the $35.00 already paid. Accordingly, I hereby substitute my finding for that of the Officer and order the employer to pay the employee $3,965.00, together with interest calculated in accordance with the provisions of the Courts of Justice Act.
