DECISION OF THE BOARD; August 28, 2000
Decision
By decision dated August 15, 2000, the Board directed the conduct of a representative vote in order to determine which of the Canadian Health Care Workers, International Union of Operating Engineers or CAW-Canada will represent employees of St. Joseph’s Health Services Association of London Incorporated in the Service Unit as defined in that decision.
Issues arose concerning what access each of the trade unions would have to the employees who are entitled to vote. A teleconference call was held on August 28, 2000 for the purpose of hearing submissions from each of the affected parties. At the conclusion of such teleconference the following orders were made:
i) each of the three trade unions can have two representatives present for the purpose of handing out leaflets at the entrances of each site (excluding any emergency entrances) on two occasions of two hours each during each 24 hour period between the time of the Board’s order and 12:00 midnight on Wednesday, August 30, 2000;
ii) each of the three trade unions can have one representative present sitting in the cafeteria of the Grosvenor and Parkwood sites, for the purpose of communicating with and/or handing out literature to employees who are entitled to vote, on two occasions of two hours each during each 24 hour period between the time of the Board’s order and 12:00 midnight on Wednesday, August 30, 2000;
iii) each of the three trade unions is to provide counsel for the employer with written notice of the time and place that it intends to leaflet or attend at a cafeteria no later than 5:00 p.m. on August 28, 2000. No leafleting or access to a cafeteria can occur until such notice has been given.
iv) The CAW and CHCW are each to post one eight inch by eleven inch notice, prepared and provided by the other trade union, on its bulletin board concerning when a representative will be available to meet with the employees in the cafeteria.
