Decision
This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the “Act”) alleging that the responding party has breached section 74 of the Act.
The essence of the complaint is that the applicant’s grievance dated December 3, 1998 (#16-98) was “dropped by the responding party without giving me any reason and without my knowledge". The remedy requested is that the grievance proceed “to arbitration and take whatever steps to restore the situation”.
In its reply the responding party states that the union has not withdrawn or settled grievance #16-98.
In the circumstances given the statement of the responding party and the remedy requested, this application would seem to be premature. The matter, is therefore adjourned sine die for a period not exceeding one year. Unless within that time either party requests that the Board proceed with the matter, it will be deemed terminated without any further notice to the parties.
