DECISION OF THE BOARD
1This matter is an application pursuant to section 64 (now 69) and subsection 1(4) of the Labour Relations Act (the "Act"). By decision of the Board (differently constituted) dated July 19, 1999, a sale of business from Volta Electrical Contractors Ltd. ("Volta") to 1086289 Ontario Inc. c.o.b. as Urban Electric Contractors ("Urban") was declared to have occurred. In addition, pursuant to subsection 1(4) of the Act, the Board declared Volta and Urban to be one employer for the purposes of the Act. As a result of such declarations, the Board further declared Urban to be bound to the relevant collective agreement.
2On August 17, 1999, Urban filed a request for reconsideration of the Board's July 19, 1999 decision. Such request was dismissed by the Board (as originally constituted) by decision dated January 6, 2000. On February 2, 2000, Urban filed a second request for reconsideration of the Board's July 19, 1999 decision. By decision dated August 14, 2000, the Board (as originally constituted) indicated that the request for reconsideration ought to be heard by a current vice-chair of the Board and accordingly directed that the Registrar of the Board set the matter down for hearing before a vice-chair.
3Having regard to the fact that hearings in respect of referrals of grievances to arbitration by the IBEW Construction Council of Ontario on behalf of International Union of Electrical Workers, Locals 353, 894 and 1739 and each of Locals 353, 894 and 1739 on its own behalf as against Volta and Urban have commenced before me, the Chair of the Board has assigned Urban's request for reconsideration of the July 19, 1999 decision in respect of this matter to me for determination.
4The request for reconsideration will be heard on September 12, 2000 commencing at 9:30 a.m. at the Board's offices located at 505 University Ave., 2nd Floor, Toronto, Ontario.
