DECISION OF THE BOARD; February 17, 2000
1This is a reconsideration of the Board’s decision dated February 15, 2000 in which the Board ordered a representation vote to be held on February 17, 2000 date. In its decision the Board ordered that the ballot box be sealed.
2The responding party gives notice under section 8.1 of the Labour Relations Act, 1995 (the "Act"). The responding party disputes the applicant’s estimate of the number of employees in the applicant’s proposed bargaining unit, as well as the applicant’s description of the unit. The Board, after comparing the membership evidence provided by the applicant as against the information provided by the responding party, finds that the numerical difference between the parties is not significant. The applicant has established sufficient membership support in its proposed bargaining unit for the purposes of obtaining a representation vote and having it counted. Accordingly, after reconsidering its original decision, the Board hereby directs that the ballot box not be sealed other than in respect of the segregated ballots mentioned in paragraph 4 of its original decision.
