DECISION OF THE BOARD; February 2, 2000
1This matter is a referral of a grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995 (the "Act").
2By letter dated February 1, 2000 to the Registrar of the Board, the applicant requests a pre-hearing production order. It is not apparent on the face of such letter that a copy has been delivered to the responding party as required by Rule 33 of the Board's Rules of Procedure. Accordingly, the applicant is hereby directed to forthwith provide the Board with a statement of delivery pertaining to the February 1, 2000 letter.
3The documents sought by the applicant are relevant to the issues in dispute. The responding party is hereby directed to produce to the applicant, no later than 12:00 noon, February 9, 2000 the following documents:
- A copy of the contract between Disc Electric and Simply Electric, including but not limited to documents outlining the terms of the contract, the scope of the work, the schedule for the performance of the work, and any interim or progress billings and/or payments;
- A copy of the invitation to tender in respect of the work in issue at the 1600 Walkley Road, Ottawa job-site, along with the complete bid and any associated tender documents submitted by Simply Electric;
- A copy of the executed contract between Disc Electric and Simply Electric;
- A copy of the work schedule and any progress billings in respect of the contract between Disc Electric and Simply Electric;
- Payroll records for all employees who worked on the 1600 Walkley Road job-site;
- A copy of the hydro and/or other permits related to the 1600 Walkley Road project;
