DECISION OF THE BOARD; April 28, 2000
By letter dated March 28, 2000, the Greater Toronto Sewer and Watermain Contractors Association (“GTSWCA”) requests that the Board reconsider or clarify its March 22, 2000 decision wherein these matters were dismissed. In response to a request from the Board, Labourers’ International Union of North America, Local 183 (“Local 183”) and International Union of Operating Engineers, Local 793 (“Local 793”) provided the Board with their comments relating to the request. Local 793 takes no position with respect to the request. Local 183 asserts that, assuming the request to relate to Board File No. 2558-98-M alone, it has no objection to the Board clarifying its decision in the manner requested.
As indicated by Local 183, it would appear that GTSWCA’s concern relates to the disposition of Board File No. 2558-98-M and not to Board File No. 2306-98-U. Having regard to the request and Local 183’s response thereto, I hereby clarify that the Board’s March 22, 2000 decision dismissing Board File No. 2558-98-M is without prejudice to the merits of the application and without prejudice to the ability of the GTSWCA to bring the sector issue back on for determination should the disposition of Board File No. 2262-98-G not be dispositive or should other labour relations factors create a need for a sector dispute.
