DECISION OF THE BOARD; June 28, 2000
1Having regard to the agreement of the parties, the Board hereby adjourns this application sine die for a period not exceeding one year. Unless within that time either party requests that the Board proceed with the matter, it will be deemed terminated without any further notice to the parties.
2The Board notes that the responding party has failed to file a Notice of Intent to Defend (Form A-87). In its application, the applicant had asked the Board, in the event of a failure to file such a Notice, to determine a portion of the referral with reference only to the material filed by the applicant. In light of the agreement to adjourn, the Board will not act on this request at the present time.
3However, if the applicant requests this matter to be re-listed, the responding party is directed to file its Notice of Intent to Defend within five working days of the date of the applicant’s request. If the responding party fails to do so, the Board may act on the applicant’s request for a decision at that time.
