DECISION OF THE BOARD; July 21, 2000
1This is an application for certification.
2On June 27, 2000, the Board (differently constituted) ordered that a representation vote be held in the following voting constituency:
all employees of Medical Pharmacies Ltd. in Durham Region, save and except Managers, persons above the rank of Manager, Office/Clerical, Pharmacist, students employed during the school vacation period and any person for whom a trade union held bargaining rights on the date of application.
3A representation vote was held on June 29, 2000. However, the ballots cast by part-time employees were not segregated from ballots cast by full-time employees, contrary to the direction of the Board. The Board finds that it is necessary to hold another vote in order that its original decision can be carried out and the ballots be properly segregated and counted separately.
4Accordingly, another representation vote shall be held on July 27, 2000. Other vote arrangements will be as determined by the Registrar and set out on the attached “Notice of Vote and Hearing”.
5The original hearing date is cancelled.
6All other findings and directions of the Board in its decision of June 27, 2000 continue to apply except to the extent that they are altered by this decision.
7The responding party is directed to post copies of this decision and of the "Notice of Vote and of Hearing" adjacent to each of the posted copies of the "Notice to Employees of Application for Certification". These copies must remain posted for 30 days.
