4118-98-ES Roger Samarita, Applicant v. Estate of Arthur Gelber, and Ministry of Labour, Responding Parties.
BEFORE: David A. McKee, Vice-Chair.
DECISION OF THE BOARD; April 25, 2000
1The Board is in receipt of correspondence from solicitors for the applicant and responding party dated March 14, March 28 and April 11, 2000. Having regard to the contents of those letters,
The Board directs the parties to meet with a Labour Relations Officer on or before June 21, 2000 to attempt to settle or at least narrow the matters between them.
If the matter is not resolved in this fashion, the applicant may request the Registrar to set a date for a hearing in this matter. At the time of making such request, the applicant shall consult with the responding party and the Ministry of Labour with respect to a date convenient to all parties.
In future, the applicant and counsel are directed to copy both the Estate of Arthur Gelber (or if counsel is later retained, that counsel), the Ministry of Labour and the Registrar of the Board with all correspondence and any other material filed with the Board. Anything received by the Board which has not been so copied will not be acted upon by the Board. Counsel is referred to rule 111.
If the matter is not resolved, the responding party may, after a hearing date has been set, renew its request for a dismissal of the application.
After the release of this decision, the address for the responding party will be amended as requested in counsel’s letter of April 11, 2000.
2This matter is referred to the Manager of Field Services.
