DECISION OF THE BOARD; April 3, 2000
1The style of cause is hereby amended to reflect the correct name of the responding party: “Ontario Nurses’ Association”.
2This is an application under section 96 of the Labour Relations Act, 1995, S.O. 1995, c.1, as amended ('the Act') in which the applicant claims that the responding trade union ('the union') has violated section 74 of the Act.
3The applicant’s compliant is concerned entirely with matters internal to the union. It does not directly concern the union in its relations with the applicant’s employer. Section 74 is available to employees for the purpose of ensuring fair trade union representation for them in relation to their employers. The section is not intended to provided a means for addressing dissatisfaction regarding the internal workings of a trade union.
4In the circumstances the application does not disclose a prima facie case of a violation by the union of its obligations under the Act. The application is dismissed.
