Decision of the Board
1This is an application for a review of a decision of an Employment Standards Officer not to issue an Order to pay under the provisions of the Employment Standards Act, R.S.O. 1990 ch. E-14. This application is brought pursuant to section 67.
2The Board has received correspondence from the parties alleged to be the employer in the employee’s application. The address changes will be noted on the Board’s records. It appears from the Officer’s narrative report that he has treated the two corporations as a single employer (pursuant to section 12) or as successor and predecessor employers (as defined in section 13). This issue will not be open to litigation before the Board unless some party chooses to make it an issue in these proceedings.
3The employer has also asked the Board for advice on a number of issues. The Board is an adjudicative tribunal and cannot give advice to one party or the other. We note the list of addresses contains the name of a lawyer, and can only suggest the employer seek advice from others.
