DECISION OF THE BOARD; March 22, 2000
This is an application under section 61(1) of the Occupational Health and Safety Act (the “Act”) appealing an order made by OSHA Inspector Rick Taggart in Field Visit No. 795709 dated February 9, 2000. The application was sent by registered mail on March 15, 2000 and received by the Board on March 16, 2000.
Section 61(1) of the Act provides for a party to appeal an inspector’s order within 30 calendar days. March 10, 2000 was the deadline for making this appeal.
As this application is untimely and there is no statutory provision permitting the Board from relieving against the time within which appeals must be made, this application is dismissed.
