DECISION OF THE BOARD; December 27, 2000
This is a request for reconsideration of a decision dated September 1, 2000.
The applicant asserts that she did not receive the notice of hearing wherein the matter was scheduled for September 1, 2000. That notice of hearing was dated July 24, 2000 and was not returned to the Board.
The reconsideration request is not timely. It was filed with the Board on December 11, 2000.
Rule 96 of the Board’s Rules of Procedure provides that:
No request for reconsideration will be considered where it is filed more than twenty (20) days after the date of the Board's decision, except with the permission of the Board.
The applicant does not provide an explanation for the late filing of the reconsideration request. She is directed to do so within two (2) weeks of the date of this decision with copies to the other parties.
The other parties to this application are directed to file submissions within two weeks of receipt of the applicant’s material as to their positions with respect to (a) the lateness of the reconsideration application and; (b) the applicant’s position that she did not receive the notice of hearing. I will then determine the reconsideration request.
