Decision of the Board
1The Board is in receipt of a letter dated January 26, 2000 from Lixi Ma objecting to the processing of this application on the basis that it was not filed in a timely manner. The application was in fact received by the Board on September 15, 1999. It was returned to the applicant due to the fact that it was filed by facsimile transmission. A further application was received by the Board on October 26, 1999. It was returned to the applicant due to the fact that it was filed by Registered Mail. A further application was received by the Board, by way of hand delivery, on November 29, 1999.
2The Board has the discretion to grant an extension of time for the filing of an application. It is my determination that, to the extent it is necessary, it is appropriate to grant an extension in this case. Accordingly, even if the application was filed beyond 45 days of the officer’s order, it is timely.
3This matter will proceed in the usual manner.
