Decision of the Board
1The Board is in receipt of correspondence dated August 23, 2000 from counsel for the applicant in which the Board is asked to direct the responding party to produce certain documents on or before September 5, 2000. In correspondence dated August 29, 2000, counsel for the responding party advises that its client will produce all relevant documents which are in its possession. Counsel goes on to assert, however, that a number of the documents requested by the applicant are not relevant to these proceedings and that its client should not be directed to produce by the Board.
2The hearing in these matters is scheduled to be continued on September 12, 13, 19 and 20, 2000. In light of the relatively short period of time before the next day of hearing, the Board proposes to deal with the production request in the following manner.
3The Board hereby directs the responding party to produce to the applicant on or before September 8, 2000 those documents which are in its possession and which it feels are arguably relevant to these proceedings.
4The Board further directs the responding party to advise the Board and the applicant by no later than September 8, 2000, of those documents which are in its possession but have not been produced and the reasons why they have not been produced (i.e. why they are not arguably relevant to these proceedings).
5If there continues to be a dispute regarding the scope of production, the parties should be prepared to make submissions on the next scheduled hearing date.
6This panel remains seized with this matter.
