This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the "Act") alleging violation of section 74.
The matter was scheduled for a consultation to be held on April 4, 2000. The parties were duly notified by the Registrar and there is no indication in the Board’s file that any party failed to receive the Notice of Consultation or was unable to attend.
On April 4, 2000, the applicant failed to appear by 10:00 a.m., thirty minutes past the scheduled time for commencement. The responding party requested that the matter be dismissed, noting that it had gone to considerable effort and expense to be present at the hearing. The Board also notes that the Manager of Labour Relations for the applicant’s employer, Windsor Casino, was also present.
The application is hereby dismissed.
