DECISION OF THE BOARD; January 20, 2000
The applicant has requested clarification of the Board’s decision dated December 21, 1999 in Board File 1014-99-U. In particular, the applicant requests the Board’s position on the applicant’s request, found in the Minutes of Settlement entered into between the parties, that it be granted leave to withdraw its application in Board File 1015-99-U.
The application in Board File 1015-99-U was dismissed by decision of the Board (differently constituted) dated August 3, 1999. Accordingly, there was no need for the union to withdraw such application as part of its settlement.
Nevertheless, and to eliminate any confusion that may exist out of the Board’s decision of December 21, 1999, particularly in light of the letter from applicant’s counsel dated August 6, 1999 and the Board’s endorsement dated September 8, 1999, the Board hereby grants leave of the applicant to withdraw its application in Board File 1015-99-U.
