DECISION OF THE BOARD; January 20, 2000
1On December 1, 1999 the Registrar of the Board sent each of the responding parties a Form B-16 – Confirmation of Filing of Application under section 69 and/or subsection 1(4) of the Act, a Form B-18 - Notice to Employees of Application under section 69 and/or subsection 1(4) of the Act and a Form A-26 – Confirmation of Posting. In relation to Board File No. 2589-99-G, the Registrar of the Board sent C.N.R. Contracting a Form B-67 – Confirmation of Filing of Referral of Grievance to Arbitration and Notice of Hearing. The materials mailed to each of the responding parties have been returned to the Board. In the case of H & R Contracting and St. Lawrence Drywall the returned envelopes bear the notation “Return to Sender Wrong Adr.”. In the case of C.N.R. Contracting, the returned envelope bears the notation “no such person at this address return to sender”.
2A response was filed on behalf of H & R Contracting and St. Lawrence Drywall on January 5, 2000. The response indicates that the address for H & R Contracting and St. Lawrence Drywall is R.R. #4, Box 17, Prescott, Ontario, K0E 1T0.
3Correspondence received from counsel for H & R Contracting and St. Lawrence Drywall suggests that correspondence to C.N.R. Contracting was sent to the proper address but returned because it was marked to the attention of Robert Kelso.
4Having regard to the foregoing, the Case Processing Assistant assigned to Board File No. 2596-99-R is hereby directed to send, by way of overnight courier, a Form B-16, Form B-18 (bearing a new terminal date) and a Form A-26 to H & R Contracting and St. Lawrence Drywall and at the following address:
