2239-99-U Marie L. Murchison, Applicant v. Ontario Nurses Association, Responding Party v. Hotel-Dieu Grace Hospital, Intervenor.
BEFORE: David A. McKee, Vice-Chair.
DECISION OF THE BOARD; May 5, 2000
In a decision dated March 14, 2000 the Board directed the applicant to make certain submissions. Among those submissions was to be an identification of the nurse(s), if any, employed in the Chronic Care Unit at the Windsor Regional Hospital whose seniority was less than that of the applicant. In the same decision ONA was directed to supply the applicant with sufficient documentation to be able to answer that question.
The applicant’s submissions identify seven nurses employed in a part-time capacity in the Windsor Regional Hospital. The units on which they work are identified as ICU (1), T2W (2), T3W (3) and T4E (1). While the Board assumes ICU stands for Intensive Care Unit (and is therefore not the area in which the applicant wished to work), it is very reluctant to speculate on the meaning of T3W, etc. There is a unit listed as CC2, but there is no indication in the applicant’s submissions as to what that refers to.
In fairness, the applicant may not know, although paragraph 17 (1) of the March 14, 2000 decision required ONA to provide information which would enable her to identify those at work in the Chronic Care Unit. The applicant is directed to advise the Board which, if any, of the seven nurses identified in her submissions work in the Chronic Care Unit. ONA is directed to provide to counsel for the applicant any assistance and documents necessary to answer this question. The Board expects the applicant’s submissions to be filed in a reasonable time frame.
