This is a referral of a grievance in the construction industry to arbitration pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”).
Although the employer has failed to file a Notice of Intent to Defend, the Board is unable to issue a default judgement as the applicant union has failed to provide the Board with any evidence that the responding party is bound to a collective agreement with the applicant or the employee bargaining agency.
The hearing to be held on June 26, 2000, will proceed as scheduled.
