0676-00-ES Carlo Di Nardo, Applicant v. Paradise Banquet & Convention Centre, and Ministry of Labour, Responding Parties.
BEFORE: David A. McKee, Vice-Chair.
DECISION OF THE BOARD; July 14, 2000
1By a decision dated June 28, 2000 the Board extended the time for filing this application pursuant to section 68(14) of the Employment Standards Act, RSO 1990, ch. E-14 (“the Act”). In doing so, it referred to the fact that monies were paid in trust in the time required by the Act. This was an error on this Vice-Chair’s part. The application is made by an employee and the monies were paid in trust by the employer. Under section 21.1 of the Statutory Powers and Procedure Act, RSO 1990, ch. 22, the Board has the authority to correct any obvious errors. This is such an error.
2Notwithstanding the absence of the issue of the timely payment of money, for the remaining reasons set out in the decision, the Board is still persuaded that this is an appropriate case in which to extend the time for filing the application. The Board confirms its decision of June 28, 2000 to that effect.
