Schlumberger Canada Limited v. Ministry of Labour
File Nos.: 1348-99-HS; 1349-99-HS Parties: Schlumberger Canada Limited, Applicant v. Ministry of Labour, Responding Party.
BEFORE: Patrick Kelly, Vice-Chair.
APPEARANCES: Michael G. Horan, Lane Brennan and Steve Dramwitzke for the applicant; Bruce Arnott and Don Frenette for the Ministry of Labour.
DECISION OF THE BOARD; February 25, 2000
1Board File No. 1349-99-HS deals with a suspension application of two orders of an Occupational Health and Safety inspector pertaining to Regulation 784/93 made pursuant to the Occupational Health and Safety Act (the “OHSA”). By decision dated August 31, 1999, a differently constituted panel of the Board suspended these two orders. By decision of September 3, 1999, the same panel clarified that the period of suspension would end on the first day of the hearing of the appeal in Board File 1348-99-HS.
2This is an interim decision.
3At the commencement of the hearing of the appeal of the two orders referred to above on February 23, 2000, the parties indicated that they were in agreement to continue the suspension of the orders until the issuance of a decision in Board File 1348-99-HS.
4Having regard to the agreement of the parties, and taking into account that there do not appear to have been any new circumstances that would affect the determinations in the Board’s August 31, 1999 and September 3, 1999 decisions, the Board hereby extends the suspension of the orders to the date on which a final decision in Board File 1348-99-HS is issued.
“Patrick Kelly”
for the Board
