DECISION OF THE BOARD; May 4, 2000
1This is an application under section 96 of the Labour Relations Act, 1995 (the “Act”) alleging a violation of section 74. In their responses the responding parties claim that the application does not disclose facts upon which the Board could find that they have violated the Act and they ask that the application be dismissed without a consultation. Section 74 of the Act can only apply to unions and not employers so Now Communications Inc. will be considered an intervenor in this application.
2The Board hereby directs the applicant to file submissions in response to the request that the application be dismissed without a consultation. The submissions should specify what acts the union is alleged to have committed which the applicant claims are violations of the Act. The submissions should also identify any facts included in the responses with which the applicant disagrees, if any. The submissions should be provided to the other parties and submitted to the Board on or before Friday, May 19, 2000.
3After reviewing the submissions the Board will decide whether to dismiss the application or to set it down for a consultation.
