DECISION OF THE BOARD; June 7, 2000
1This is an application filed pursuant to section 61(1) of the Occupational Health and Safety Act (the “OHSA”). The applicant seeks to appeal the refusal of the inspector to issue an order.
2The parties who attended the hearing were able to clarify a number of matters and, as a result of those clarifications, agreed to adjourn these proceedings sine die.
3First of all it was agreed that, if this matter needs to proceed further, the applicant will be seeking that the Board issue an order with respect to the production and maintenance of certain electrical drawings or blueprints. It was clarified that these proceedings were not intended to be and will not be permitted to be some kind of proxy for a disciplinary process aimed at the Ministry or its inspector.
4With that clarification, the Ministry indicated that it was prepared, on behalf of the inspector, to indicate that meetings would be arranged, as soon as is practical, between the inspector and the Joint Health and Safety Committee and between the inspector and the worker who initially expressed the concerns which resulted, ultimately, in this application. The purpose of these meetings will be to review and discuss any concerns which may exist with respect to the production and maintenance of the drawings/blueprints in question.
5In view of the above, the parties agreed and this matter is therefore hereby adjourned sine die for a period not to exceed one year. Unless any of the parties request
in writing, within that time period, that the matter be re-listed for hearing, it will be deemed to have been terminated one year from the date of this decision.
