Ontario Labour Relations Board
Between: Service Employees International Union, A.F.L.-C.I.O., C.L.C., Applicant v. Local 210 Staff Association and Service Employees International Union, Local 210, Responding Parties.
Before: Caroline Rowan, Vice‑Chair, and Board Members J. A. Ronson and R. R. Montague.
Decision of the Board: September 15, 2000
Decision
1In its letter dated September 13, 2000, the applicant, the Service Employees International Union (the “SEIU”), takes the position that the responding party, Local 210 Staff Association (the “Association”) should be required to provide the supporting documents referred to by the Association in its response forthwith. The Association, on the other hand, has taken the position that these supporting documents should not be provided to the SEIU at all given their confidential nature until such time as the issue of SEIU’s legal standing to bring this application has been determined.
2By decision dated September 11, 2000, the Board declined to determine the issue of the applicant’s standing prior to the hearing, and indicated that the Association may raise its preliminary objection challenging the applicant’s standing before the panel of the Board assigned to hear this matter. In all of the circumstances, the issue of production of documents will also be dealt with by the panel of the Board assigned to hear this matter.
